Chubara Ventures, LLC ("Chubara") operates LandscapeExchange.com (the "Website"). It is Chubara's policy to respect your privacy regarding any information we may collect while operating our website.

Definitions

Consumer - A Consumer means any User of LandscapeExchange who browses designs and/or signs up for an account with LandscapeExchange.

Service Provider - A Service Provider means an individual, organization or any other recognized legal entity that registers as such on LandscapeExchange.com and/or communicates with a Consumer. If a Service Provider is a corporate entity, the term "Service Provider" shall include the affiliated personnel performing services on behalf of such Service Provider.

User - A User is any Consumer and/or Service Provider that registers with LandscapeExchange and makes use of and/or benefits from the Website.


Website Visitors

Like most website operators, Chubara collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Chubara's purpose in collecting non-personally identifying information is to better understand how Chubara's visitors use its website. From time to time, Chubara may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

Chubara also collects potentially personally-identifying information like Internet Protocol (IP) addresses. Chubara does not use such information to identify its visitors, however, and does not disclose such information, other than under the same circumstances that it uses and discloses personally-identifying information, as described below.

Gathering of Personally-Identifying Information

Certain visitors to Chubara's websites choose to interact with Chubara in ways that require Chubara to gather personally-identifying information. The amount and type of information that Chubara gathers depends on the nature of the interaction. For example, we ask visitors who sign up for an account at LandscapeExchange.com to provide a username and email address. Those who engage in transactions with Chubara — by purchasing access to the Pro Services, for example — are asked to provide additional information, including as necessary the personal and financial information required to process those transactions. In each case, Chubara collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor's interaction with Chubara. Chubara does not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.

Information Sharing and Disclosure

We want you to understand when and with whom we may share personal or other information we have collected about you or your activities on our web site or while using our services. We do not share your personal information with others except as indicated below or when we inform you and give you an opportunity to opt out of having your personal information shared. Under no circumstances, other than in the event of a Business Transfer (as discussed below) will Chubara sell, rent or lease its Consumer lists (or the Consumer list of any individual Service Provider) to a third party.

Circumstance under which we may share your personal information:

To provide information to Service Providers. We may share your personal information with Service Providers registered with LandscapeExchange.com that perform certain services on behalf of Consumers. Sharing this information with Service Providers allows them to find consumers and offer them the best service at competitive pricing. The information we share is generally the location of the user and the details of the service the user wants.

To Provide Information to Consumers. If you are a registered Service Provider, we may share your personal information with Consumers requesting services through LandscapeExchange.com. Sharing this information with Consumers helps them to assess a Service Provider's quality and select the Service Provider to perform the service they need done. The information we share is generally the information on your profile.

To Facilitate the Website's Use of Third-Party Services. We engage certain trusted third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance, customer relationship, database storage and management, direct marketing campaigns and User credit card information storage. We will share your personally identifiable information with these third parties, but only to the extent necessary to perform these functions and provide such services, and only pursuant to binding contractual obligations requiring such third parties to maintain the privacy and security of your data.

To Comply with Laws and Law Enforcement. Chubara cooperates with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims, legal process (including subpoenas), to protect the property and rights of Chubara or a third party, the safety of the public or any person, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law.

In Connection with Business Transfers. Chubara may sell, transfer or otherwise share some or all of its assets, including your personally identifiable information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy. You will have the opportunity to opt out of any such transfer if the new entity's planned processing of your information differs materially from that set forth in this Privacy Policy.

Use of Contact Information.

In general, we may use information that we collect about you to:
  • deliver the products and services that you have requested
  • manage your account and provide you with customer support
  • perform research and analysis about your use of, or interest in, our products, services, or content, or products, services or content offered by others
  • communicate with you by e-mail, postal mail, telephone and/or mobile devices or send newsletters about products or services that may be of interest to you
  • communicate with you with regard to partially completed service requests or job offers
  • develop and display content and advertising tailored to your interests on our site and other sites
  • verify your eligibility and deliver prizes in connection with contests and sweepstakes
  • enforce our terms of use
  • manage our business; and
  • perform functions as otherwise described to you at the time of collection.
Aggregated Statistics

Chubara may collect statistics about the behavior of visitors to its websites. For instance, Chubara may monitor usage on LandscapeExchange.com site. Chubara may display this information publicly or provide it to others. However, Chubara does not disclose personally-identifying information other than as described below.

Protection of Certain Personally-Identifying Information

Chubara discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Chubara's behalf or to provide services available at Chubara's websites, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Chubara's websites, you consent to the transfer of such information to them. Chubara will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, Chubara discloses potentially personally-identifying and personally-identifying information only when required to do so by law, or when Chubara believes in good faith that disclosure is reasonably necessary to protect the property or rights of Chubara, third parties or the public at large. If you are a registered user of an Chubara website and have supplied your email address, Chubara may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what's going on with Chubara and our products. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Chubara takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Cookies

A cookie is a string of information that a website stores on a visitor's computer, and that the visitor's browser provides to the website each time the visitor returns. Chubara uses cookies to help Chubara identify and track visitors, their usage of Chubara website, and their website access preferences. Chubara visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Chubara's websites, with the drawback that certain features of Chubara's websites may not function properly without the aid of cookies.

Ads

Ads appearing on any of our websites may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by Chubara and does not cover the use of cookies by any advertisers.

Security

Chubara is very concerned about safeguarding the confidentiality of your personally identifiable information. We employ administrative, physical and electronic measures designed to protect your information from unauthorized access. However, we cannot guarantee that hackers or unauthorized personnel will not gain access to your personal information despite our efforts. You should note that in using the Website, your information will travel through third party infrastructures which are not under our control.

Privacy Policy Changes

Although most changes are likely to be minor, Chubara may change its Privacy Policy from time to time, and in Chubara's sole discretion. Chubara encourages visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.
